5. Participation Fees
If not specified differently in the description of services
for the exhibition, apart from all general services such as
general organization of the exhibition, extensive visitor
promotion, general security, cleaning of the aisles in the
halls etc., the participation fee for space including
standard construction covers additional standard settings
and equipment according to stand size. The respective
contents of the standard package for each size will be
listed separately for each event in the detailed basic info
folder. The fees for stand construction approval (management
fee) by the fairground owners/organisers can be
found in the exhibitor manual. Prime booth locations, i.e.
with two, three or four open front sides, are subject to
additional charges per square meter as specified in the
registration form to be submitted. A 50% surcharge will be
charged for two-storey stands (for the fitted area) on raw
space price per sqm. All charges are plus domestic and
foreign value-added tax if applicable.
6. Registration
Registrations will only be accepted if the attached form is
completed in full, accepting these conditions of participation,
with legally binding signature. The completed form is
to be addressed to:

Any conditions attached to the registration by the signing
company will not be accepted. Requests for particular
locations which will be considered as far as possible, but
do not constitute preconditions for participation. No
guarantee is given in respect of the presence of competitors.
Registration alone does not constitute acceptance by
the Organizer. Legally binding registration is not
considered to have been effected until it has been
received by the Organizer, and it is binding until it has been
accepted or definitely refused
7. Acceptance
No legal right to acceptance exists. Exhibitors which do
not meet their financial obligations towards the company
organizing the exhibition or which have contravened these
conditions can be excluded from acceptance. In case of
overbooking the right of selection is reserved. Acceptance
of exhibitors will be confirmed in writing and is only valid
for the exhibitor named in the letter of confirmation. The
contract between exhibitor and Organizer becomes valid
with the mailing of the acceptance. The Organizer is
entitled to withdraw acceptance if it was given on the
basis of false premises or the preconditions of acceptance
are subsequently no longer applicable.
8. Allocation and Change of Allocation
Should the allocated area not be available for reasons
beyond the Organizer’s control, the exhibitor is not entitled
to reimbursement of the participation charge. No right to
claim damages exists. Giving reasons, the Organizer may,
if circumstances should so dictate, allocate a location
other than the one stated in the acceptance or alter the
size of the stand by a maximum of 15 p.c. Partition walls,
columns and projections, as well as hydrants, fire
extinguishers, etc. are considerated part of the allocated
stand and it is the exhibitors duty to inform himself on size
and location of the above mentioned. No reclamations are
accepted after finishing of setting up. Reclamations have
to be submitted at least 3 days before the opening of the
exhibition in written form to the Organizers. No compensation
may be claimed, even in case of errors of allocation.
9. Terms of Payment
On acceptance the exhibitor has to pay the full charge for
the rented exhibition space. Any complaints must be
made in writing immediately on receipt of the invoice.
Objections raised at a later date cannot be considered.
The invoice on space rental is due to payment within 4
weeks, but at least until the official registration deadline.
Any invoice dated later than the official registration deadline
is due to immediate payment. Please remit your deposit

The full fee for participation has to be paid to the a.m.
account, bank fees for money transfer cannot be deducted
from payment due as specified in the invoice. In the case of
late payment on the part of an exhibitor (also in cases of
space not fully paid for) the Organizer is entitled to withdraw
availability of the entire space authorized and dispose of it
at his discretion. In case of late payment interest of 8 p.c. is
charged. Exhibitors- and Setting-up passes are only
handed out after full payment of stand rental and all other
fees. The Organizer is entitled to withhold equipment and
exhibits of the client and sell it after written notification to
cover the expenses, if payment has not been effectuated
within the period settled.

10. Co-Exhibitors and Joint Stands
Without the consent of the Organizer, exhibitors are not
permitted to make available all or parts of the stand
allocated to them to third parties either in return for payment
or free of charge. No advertising or promotion of firms not
named in the acceptance is permitted on the stand.
Applications for the inclusion of a co-exhibitor must be
made to the Organizer in writing. A co-exhibitor fee as
stipulated in the special conditions for each single event will
be payable to the Organizer. In all cases the exhibitor which
is the registered user of the stand is liable for payment of the
co-exhibitor fee. The co-exhibitor is subject to the same
terms and conditions as the main exhibitor. The Organizer
may authorize large joint stands of exhibitors, provided that
they can be incorporated into an appropriate subdivision of
the exhibition. All regulations apply to each exhibitor. If a
stand is allocated to two or more firms jointly, each firm is
liable for the total fee towards the Organizer. Firms
exhibiting on a joint basis should name a joint representative
in their registration.
11. Cancellation or Non-Participation
11.1 If the Exhibitor decides to withdraw its application for
participation, gives up participation or reduces the stand
space after submission of the Application form, the
Exhibitor shall forthwith notify the Organizer in writing
(“Withdrawal Notice"). The respective request of the
Exhibitor shall only become effective upon written
acceptance by the Organizer of such Withdrawal Notice.
Upon issuance of the Admission Notice, it is in the Organizer's
sole discretion and without any obligation of the
Organizer to accept the `Withdrawal Notice.
11.2 If the Organizer does not accept the Withdrawal
Notice, the Exhibitor shall participate in the Exhibition under
the conditions as approved by the Organizer and the
relevant provisions of Article 7 and make the payments
according to Article 8 of this Application. The Exhibitor shall
bear all the losses and damage which may be incurred to
the Organizer due to non-participation.
11.3 After submitting the application for participation,
should the Exhibitor decides to withdraw the application or
cancel the participation, the organizer has the right to
charge in certain percentage of the total participation fee to
cover any loss due to cancellation. Cancellation fee refer to
the Application Form of each show.

The amount of the co-/sub-exhibitor fee shall be payable.
12. Exhibition Catalogue
The Organizer will issue an official online exhibition
catalogue. The standard entry to the catalogue is obligatory
and exemptions cannot be made. This regulation also
applies to sub-exhibitors. The organizer or an appointed
third part will submit full details on catalogue entries to the
exhibitors. No claims can be entertained for incorrect,
incomplete or omitted entries. The cost for the catalogue
entry shall be charged according to the specifications on
the adjoined sheet for each exhibition.
13. Liability and Insurance
The organizer cannot accept any liability for any liability
cases unless the organizer, its legal representatives or
agents act deliberately or grossly negligently. This
restriction of liability does not apply in the event of injury to
life, limb or health due to even minor negligence of those
obligations fulfilment of allows proper implementation of the
contract at all, infringement of which jeopardises achievement
of the purpose of the contract, and observance of
which the customer regularly relies (so-called cardinal
duties). It is the responsibility of the exhibitor to insure the
goods exhibited against all risks in connection with
transport, setting-up and dismantling and during the
exhibition, in particular against damage, theft etc. The
exhibitor shall be liable to compensate the Organizer for any
damage caused by him to the exhibition space rented,
stand material, electricity, water and sewerage systems or
any other property of the Organizer. With his acceptance of
the conditions of participation the exhibitor explicitly
releases the Organizer and firms acting on his behalf from
any rights of recourse whatsoever on the part of third
parties.
14. Exhibition Insurance
It is urgently recommended that exhibitors take out an
exhibition insurance. This should cover the standard
equipment and the exhibition goods e.g. against damage
caused by theft, fire, water, storm and the like during
construction and removal.
Third party liability insurance.
Taking out third party liability insurance to complement
employer´s liability insurance is recommended. This applies
for service providers working for exhibitors too.
15. Circular Letters
The exhibitors will be informed by the Organizer by circulars
of details concerning the preparations and running of the
exhibition. The Organizer does not accept any liability for
any consequences of disregarding these circulars.
16. Transport
Transport on the exhibition grounds will be undertaken by a
firm appointed by the Organizer. Accordingly this firm will
take over transport of objects delivered by the exhibitor or
its forwarders at the boundary of the exhibition grounds and
continue their transport on the exhibition grounds. The
exhibition management will not accept delivery of any
consignments and does not accept any liability for loss or
incorrect delivery. The costs for these transports on the
exhibition grounds are to be paid by the exhibitors to the
transport firm directly.
17. Reserved Rights
In the case of important reasons beyond his control the
Organizer has the right to postpone the exhibition, to curtail
or prolong it, to close it for certain periods, to close it
completely or in part, or to cancel it. In such justified
exceptional circumstances, as in all cases of force majeure,
the exhibitors do not have any right to withdraw or adjust

the participation charges, nor do they have any right to
claim any damages. Should the exhibition not take place for
the reasons stated above, the exhibitor can be called upon
to pay up to 25 p.c. of the participation charge to cover
general costs. Larger individual sums can only be charged if
the exhibitor has ordered additional services for which
charges are made. Should the organizer be responsible for
the cancellation no sums shall be owed. No right of
compensation exists.
18. Limitation Period
All claims of the exhibitors against the Organizer shall be in
lapse after a twelve-month period. The limitation period
begins to run from the end of the month in which the final
day of the exhibition fell.
19. Final Provision
With his registration for participation the exhibitor accepts
in full as legally binding these conditions of participation as
well as the house and ground rules in force at the exhibition
venue. Additional agreements, special permissions or other
kinds of arrangements require the written consent of the
Organizer.
20. Partial Inoperativeness
Should parts of the present conditions of participation
should be or become inoperative, this will not touch the
remaining parts of the conditions of participation. Any
inoperative part of these conditions shall be replaced by a
regulation that respects the aims and the reason of these
conditions.
20.1 By submitting data to the Organizer and/or using his
Application form the exhibitor hereby gives his/her consent
that all personal data that the exhibitor submits may be
collected, stored. processed, transferred and used by the
Organizer for the purpose of customer management and
service. The Organizer may use the exhibitor's personal
data internally to help the Organizer improve their services
and to help resolve any problems. As a global enterprise,
the Organizer and its affiliates have facilities and databases
in different countries. For improving customer Services, the
Organizer, from time to time, transfers personal data of
custodies to a database belonging to the Organizer. The
Organizer may also contact exhibitors occasionally to
inform them of new services the Organizer will be providing,
or events or articles that will be of interest to exhibitors. If
exhibitors do not wish to receive information from the
Organizer, they may withdraw their consent given to the
Organizer hereunder at any time by emailing the organizer.
20.2 The Exhibitor hereby declares that, the submission of
personal data of any individual contained in this Application
Form is made with the explicit informed consent of each
and every individual concerned and that the concerned
individual has been fully informed about the purpose for
which personal data is collected and processed by the
Organizer. In this regard, the exhibitor will indemnify and
hold harmless the Organizer from any liabilities, claims,
losses of suits, including attorney fees, arising out of or in
connection with any dispute with each and any individual
concerned due to breach of applicable data protection laws
and regulations. The data protection regulations of DLG
Asia Pacific Co., Ltd. shall apply.
21. Legal Right applicable
The law of the Federal German Republic is applicable
excluding the standardized UN commercial law.
22. Performance and Venue
Place of performance and venue in respect of all obligations
of both parties is Frankfurt, Germany. The laws of the
Federal Republic of Germany are applicable. The Organizer
reserves his right to choose the venue of the law suit.
23. Data Protection
The organizer also entrusts third parties with the provision
of contractual services in connection with this contractual
relationship. If necessary, the organizer will transmit the
collected data of the exhibitor to the third parties commissioned
by it for this purpose.
By submitting data to the Organizer and/or using this
Application form the exhibitor hereby gives his/her consent
that all personal data that the exhibitor submits may be
collected, stored. processed, transferred and used by the
Organizer for the purpose of customer management and
service. The Organizer may use the exhibitor's personal
data internally to help the Organizer improve their services
and to help resolve any problems. As a global enterprise,
the Organizer and its affiliates have facilities and databases
